Terms of Use

These terms explain who may use Wordy Birdy, the rules for accounts and imported content, and the limits that apply to the service.
1. Agreement to these terms
These Terms of Use are a binding agreement between you and Boost Open LLC, a Delaware limited liability company doing business as Wordy Birdy (“Boost Open,” “Wordy Birdy,” “we,” “us,” or “our”), governing your access to wordy-birdy.com and the Wordy Birdy language-learning service (the “Service”).
By creating an account, clicking to accept these terms, or using the Service, you agree to these terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, your parent or legal guardian must review and agree to these terms for you. The Service is not directed to children under 13, and children under 13 may not create an account or provide personal information.
You may not use the Service if doing so would violate applicable law or if we previously suspended or terminated your access for violating these terms.
3. Accounts and security
You must provide accurate information, protect your password and passkeys, and promptly notify us if you believe your account has been compromised. You are responsible for activity conducted through your account unless applicable law provides otherwise.
Guest access may be temporary and may not preserve progress. We may reclaim or remove inactive guest data as reasonably necessary to operate the Service.
4. The learning service
Wordy Birdy provides vocabulary cards, stories, translations, pronunciation tools, placement activities, practice, and spaced review. Some material may be generated or evaluated with automated systems or artificial intelligence.
The Service is an educational aid, not a certified course, translator, testing service, or guarantee of fluency. Generated translations, feedback, pronunciations, and stories may be incomplete or inaccurate. Use your judgment before relying on them in important situations.
5. Your content and imported sources
You retain ownership of word lists, responses, and other material you submit (“Your Content”). You give us a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt, analyze, and process Your Content only as reasonably needed to provide, secure, maintain, and improve the Service.
If you submit a YouTube link or other third-party source, you represent that you are permitted to access and use it. You must respect copyright, platform terms, privacy, and other rights. We may refuse or remove an import that is unavailable, unsafe, unlawful, or rights-infringing.
Your Content is not made public through the current Service unless we clearly provide a sharing feature and you choose to use it.
6. Acceptable use
You may not use the Service to:
- break the law, infringe intellectual-property or privacy rights, or facilitate harm;
- upload malware, abusive material, sexual content involving minors, or content that promotes exploitation or violence;
- probe, disrupt, overload, reverse engineer, scrape, or bypass security or access controls except where applicable law expressly permits;
- use automated means to create accounts or extract data without our written permission;
- misrepresent your identity, impersonate another person, or access another user’s account; or
- use Service output to make high-stakes legal, medical, financial, safety, or employment decisions.
7. Our content and intellectual property
The Service, including its software, design, branding, curated lessons, and other content we provide, is owned by Boost Open LLC or its licensors and is protected by intellectual-property laws. Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for personal language learning.
“Wordy Birdy,” its logos, and related branding may not be used without our permission. If you send feedback, you allow us to use it without restriction or compensation, but you are not required to provide feedback.
8. Third-party services
The Service may interact with YouTube, Google advertising, cloud hosting, email delivery, translation, speech transcription, and AI providers. Their services and content are governed by their own terms and privacy practices. We are not responsible for third-party services we do not control.
9. Changes, availability, and termination
We may add, change, suspend, or discontinue features. We do not promise that the Service will always be available, error-free, or compatible with every device.
You may stop using the Service at any time. You may request account deletion as described in the Privacy Policy. We may suspend or terminate access when reasonably necessary to protect users or the Service, comply with law, address nonpayment if paid features are introduced, or enforce these terms. Provisions that by their nature should survive termination will survive.
10. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ANY PARTICULAR LEARNING OUTCOME OR THE ACCURACY OF GENERATED OR THIRD-PARTY CONTENT.
Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOST OPEN LLC, WORDY BIRDY, AND THEIR AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID WORDY BIRDY FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits do not apply where liability cannot lawfully be limited.
12. Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules, except where the law where you live requires otherwise. Any dispute that is not resolved informally may be brought in a state or federal court with lawful jurisdiction in Delaware, unless applicable consumer law gives you the right to bring it elsewhere.
Before filing a claim, please contact us and describe the issue so we can try to resolve it. Nothing in these terms limits rights that cannot be waived under applicable consumer law.
13. General terms
If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our permission; we may transfer them as part of a reorganization, financing, merger, sale, or transfer of the Service. These terms and the policies they reference are the entire agreement concerning the Service.
We may update these terms. We will post the revised version and change the effective date, and will provide additional notice when required by law. Continued use after an update takes effect means you accept the revised terms.
